Terms of Service
Please read these Terms of Service ("Terms", "Agreement") carefully before using the byob.studio website and services offered under the name BYOB (the "Service") operated by Posterior Technologies Private Limited ("Posterior AI", "us", "we", or "our"). These Terms govern your access to and use of our services. By using our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.
1. Account Registration
1.1. Eligibility: You must be at least 13 years of age to use the Service. By creating an account, you represent and warrant that you possess the legal right and ability to enter into this Agreement.
1.2. Account Security: You are responsible for safeguarding the password and authentication credentials used to access the Service. You agree not to disclose your credentials to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
2. Description of Service
2.1. Service Overview: BYOB provides a cloud-based, AI-powered integrated development environment (IDE) and hosting platform (collectively, the "Service"). The Service enables users to create, modify, test, and deploy web applications ("User Projects") through a natural language interface, visual editors, and direct code manipulation tools.
2.2. AI Capabilities: The Service integrates third-party Large Language Models (LLMs)—including but not limited to models provided by Google, OpenAI, and xAI—to interpret user prompts and generate source code, file structures, and design assets. You acknowledge that:
2.2.1. (a) The AI functionality is probabilistic and may produce non-deterministic outputs;
2.2.2. (b) The Service does not guarantee that AI-generated code will be error-free, secure, or suitable for your specific use case;
2.2.3. (c) We may update, replace, or deprecate specific AI models at any time to improve Service performance.
2.3. Hosting and Deployment: BYOB offers infrastructure to preview and deploy User Projects. While we strive to maintain high availability, the hosting environment is provided for development and production use subject to the limitations of our underlying infrastructure providers. We do not guarantee uninterrupted access to deployed applications.
2.4. Modifications to Service: We reserve the right to modify, suspend, or discontinue, temporarily or permanently, the Service or any part of it (including specific features, AI models, or hosting capabilities) with or without notice. You agree that BYOB shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the Service.
2.5. Beta Features: From time to time, we may invite you to try "Beta" or "Experimental" features. You acknowledge that these features may be unstable, may contain bugs, and may not function as intended. We maintain no liability for any issues arising from the use of Beta features.
3. Payment and Credits
3.1. Credit System: The Service operates on a pay-as-you-go credit basis. You must purchase credits to utilize specific features, including but not limited to AI code generation, file editing, and deployment.
3.2. No Refunds: All credit purchases are final and non-refundable, except where required by applicable law. Credits have no monetary value outside of the Service and cannot be transferred to other accounts.
4. User Responsibilities
4.1. User Accounts: In order to access and use our services, you may be required to create a user account. You are responsible for maintaining the confidentiality of your account credentials and for any activities that occur under your account. You agree to provide accurate, current, and complete information during the registration process and to promptly update any changes to your account information.
4.2. Compliance with Laws: You agree to use our services in compliance with all applicable laws, regulations, and third-party rights. You are solely responsible for ensuring that the images you upload and the processing tasks you request comply with these legal requirements.
4.3. Prohibited Activities: You must not use our services for any unlawful, abusive, or unauthorized purposes. This includes, but is not limited to, uploading or processing images that infringe upon intellectual property rights, contain explicit or offensive content, or violate the privacy rights of others.
5. Intellectual Property
5.1. Ownership: We retain all rights, title, and interest in and to our platform, including any intellectual property rights associated with it. Your use of our services does not grant you any ownership or rights to our intellectual property.
5.2. Platform Rights: BYOB and its licensors retain all rights, title, and interest in and to the Service, including the interface, proprietary prompts, underlying software, and trademarks.
5.3. User Content: You retain all rights, title, and interest in and to the code, assets, and applications you create using the Service ("User Output"). You grant BYOB a worldwide, non-exclusive, royalty-free license to use, reproduce, process, and display your User Output solely for the purpose of providing and improving the Service.
6. Limitation of Liability
6.1. In no event shall BYOB, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
6.1.1. (i) your access to or use of or inability to access or use the Service;
6.1.2. (ii) any conduct or content of any third party on the Service;
6.1.3. (iii) any content obtained from the Service; and
6.1.4. (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory.
6.2. We make no warranties or representations regarding the accuracy, reliability, or availability of our services. We do not guarantee that the services will be uninterrupted, error-free, or secure.
6.3. The Service utilizes artificial intelligence to generate code. AI models may produce inaccurate, insecure, or inefficient code ("Hallucinations"). You acknowledge that BYOB makes no warranties regarding the correctness, security, or functionality of the AI-generated output.
6.4. You are solely responsible for reviewing, testing, and securing any code generated by the Service before deploying it to a production environment.
7. Indemnification
7.1. You agree to defend, indemnify, and hold harmless BYOB and its licensees and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of:
7.1.1. (a) your use and access of the Service, or
7.1.2. (b) a breach of these terms.
8. Privacy
8.1. Our collection, use, and retention of personal information are governed by our Privacy Policy. By using our services, you consent to the collection and use of your personal information as outlined in the Privacy Policy.
9. Termination
9.1. We reserve the right to suspend or terminate your access to our services at any time, without prior notice, if we believe that you have violated these Terms or any applicable laws or regulations. In the event of termination, the provisions of these Terms that by their nature should survive termination shall continue to apply.
9.2. Data Deletion: Upon termination of your account or manual deletion of a project, you acknowledge that all associated data is subject to a 30-day grace period, after which it will be permanently deleted from our systems. It is your responsibility to export your data prior to termination.
10. Changes to the Terms
10.1. We may modify these Terms from time to time to reflect changes in our services or legal requirements. We will notify you of any material changes by posting the updated Terms on our website or through other means of communication. Your continued use of our services after the effective date of the modified Terms constitutes your acceptance of the changes.
11. Governing Law and Jurisdiction
11.1. These Terms shall be governed by and construed in accordance with the laws of your country of residence.
